Legal Notices
The company Béton Jaune SAS (hereinafter referred to under the trade name “GoudronBlanc”) operates the online sale of its products on the GoudronBlanc website accessible at the following address: goudronblanc.com (the Site). The Site is published by Béton Jaune, SAS with a capital of 1,000,000 euros whose registered office is at Bougival (78380) – 19, rue Pierre Brossolette (this administrative address is not to be used for returns), identified at the RCS of Versailles under No. 892230830 and VAT No. FR06892230830.
The hosting of the GoudronBlanc Site is provided by: Ex2 Inc., service provider located at CP 70161 Québec STN Québec-centre, Québec, QC, G2J 0A2, Canada.
The publication director of the Site is Mr. Guerric de Ternay.
Access to the Site and the use of its content are subject to the general terms and conditions described below. Accessing and browsing the Site constitutes the visitor’s (or customer’s) unreserved acceptance of the following provisions.
The contents of the Site are the exclusive property of GoudronBlanc. The company is solely authorized to use the intellectual property rights present on the Site, including trademarks, models, copyrights, and image rights. The use of any part of the contents of the Site, especially by downloading, reproduction, transmission, or representation for purposes other than personal and private use for non-commercial purposes is strictly prohibited.
GoudronBlanc strives to ensure, to the best of its abilities, the accuracy and updating of the information disseminated on the Site. The company cannot guarantee the accuracy, precision, and completeness of the information made available on the Site. It reserves the right to correct, at any time and without prior notice, the content.
Object
These general terms and conditions aim to define the contractual relationships between Béton Jaune on the one hand (hereinafter referred to under the trade name “GoudronBlanc”) and the buyer (hereinafter referred to as “the Customer”) on the other hand. These conditions apply to any purchase made through the GoudronBlanc Site, whether the buyer is a professional or a consumer. The acquisition of a good through this Site implies an unreserved acceptance by the buyer of these general terms and conditions.
These terms and conditions shall prevail over any other general or special conditions not expressly agreed upon by GoudronBlanc. GoudronBlanc reserves the right to modify its terms and conditions at any time. In this case, the applicable conditions will be those in effect on the goudronblanc.com Site at the time of the order.
**Section 1: Customer, Product, and Price**
**Article 11-1: Customer**
The Customer declares to be a natural person with legal capacity or holding parental authorization allowing them to place an order on the Site. When registering their personal data, the Customer undertakes to ensure the accuracy and completeness of the mandatory data they provide. In case of error in the recipient’s details, GoudronBlanc cannot be held responsible for the impossibility of delivering the product.
**Article 12-1: Products**
The products offered for sale are those listed in the catalog published on the GoudronBlanc Site. These products are offered within the limits of available stocks. For each product, GoudronBlanc takes the utmost care in their presentation and description.
The catalog photographs are as accurate as possible but cannot ensure a perfect resemblance with the offered product, especially concerning colors. The colors seen on the online store by the Customer depend on the screen settings of each device (smartphone, computer, tablet) and the browser used. The Customer acknowledges that the photos representing the products are only indicative. These photos, like the texts illustrating the products, are not contractual.
The pre-order offers presented by GoudronBlanc are only valid within the available time and quantity for pre-order. The estimated delivery times for a pre-order offer are only indicative. They may vary depending on the type of product, the quantities ordered, and the availability of suppliers.
**Article 13-1: Price**
The prices listed in the catalog are prices inclusive of all taxes in euros, considering the VAT applicable on the day of the order. Any change in the rate may be reflected in the price of the products or services. GoudronBlanc reserves the right to modify its prices at any time. Only the price listed in the catalog on the day of the order will be applicable to the Customer. The prices indicated do not include order processing, transport, and delivery costs, provided they take place in the geographical areas provided for in Article 21-2.
Offers, discounts, and benefits are not cumulative for the same order.
**Section 2: Terms of Sale, Payment, and Delivery**
**Article 21-1: Order Procedures**
To place an order, the Customer can select one or more items and add them to their basket. Once the order is complete, they can access their basket by clicking the dedicated button. The basket review allows the Customer to verify the number and nature of the selected items and check their unit price and the overall price of the order.
The order registration on the GoudronBlanc Site is conditioned by a succession of steps that must be followed by the Customer to validate their order. Acceptance by confirming the order constitutes a sale to which the present general terms and conditions apply.
GoudronBlanc will refuse any order placed by a Customer who violates these terms and conditions or with whom there is a payment incident for a previous order or a dispute. GoudronBlanc reserves the right not to process the order if no correction is made to these elements.
Once the form is fully completed, the Customer will be invited to choose the delivery method, then to make the payment by being redirected to the chosen payment platform (see art. 22-5).
Orders (shipping and returns) are processed by a logistician contracted with Béton Jaune SAS.
Once payment is effectively received, the Customer will receive an email summarizing the order, confirming its processing. GoudronBlanc reserves the right not to process the order in case of stock shortage, obvious bug, or site hacking.
**Article 21-2: Geographical Area**
The online sale of products presented on the Site is reserved for Customers residing in France, the French overseas departments and territories, Monaco, as well as European countries, North America, and Australia.
The delivery price will be set at the required amount to deliver these geographical areas.
**Article 21-3: Warranties**
All products provided by the seller benefit from the legal guarantee provided by articles L211-4 and following of the Consumer Code. In case of obvious non-conformity of a sold product, the Customer can return it to GoudronBlanc, which will take it back, exchange it, or refund it. All claims, requests for exchange or refund must be made by registered letter, within 14 days of delivery.
**Article 21-4: Applicable Law**
Any order placed by the Customer implies full acceptance of the general terms and conditions. These general terms and conditions are governed by French law. In case of dispute, only French courts will be competent. In case of difficulty or claim when ordering, the customer can contact Customer Service to find an amicable solution.
**Article 22-1: Payment**
Products are payable in cash on the day of the order.
**Article 22-2: Payment Methods**
Purchases are paid by credit card: The Customer accesses the dedicated space provided by the payment platforms indicated in article 22-5, which ensure the security and recording of the payment order. The Customer acknowledges that communicating their credit card number to the selected platform constitutes authorization to debit their account up to the amount of the ordered products.
The shipment of the order will only take place after the check has been cashed upon receipt.
The data recorded and stored by GoudronBlanc constitute proof of the order and all transactions made. The data recorded by the payment system chosen by the Customer constitute proof of financial transactions.
**Article 22-3: Payment Default**
GoudronBlanc reserves the right to refuse an order from a consumer who has not fully paid for a previous order.
**Article 22-4: Payment Security**
Payment security is ensured by the secure payment services indicated in article 22-5. These platforms do not communicate any financial information of the Customer to GoudronBlanc. Confidential data is entered and transmitted in an encrypted manner to the payment services’ servers.
**Article 22-5: Payment Services**
Orders on goudronblanc.com are processed by the following payment services:
– PayPlug is the first French omnichannel payment solution designed for SMEs. PayPlug is a subsidiary of the BPCE Group.
– Mollie is one of the leading European payment solutions, based in Amsterdam; it handles GoudronBlanc’s Amex payments.
– PayPal is an American company offering one of the first online payment systems; it handles the payments of our customers who have a PayPal account.
**Article 23-1: Delivery Methods**
Delivery is made to the delivery address indicated by the Customer, within the geographical area agreed upon in article 21-2. The delivery address must
be the customer’s residence or any other physical person of their choice. Delivery will not be made to hotels or post office boxes.
Depending on the quantity of products purchased, the Customer may be required to contribute to the delivery costs.
The Customer must ensure that they provide accurate and complete information regarding the delivery address (including: street number, building number, staircase, access codes, names and/or intercom numbers, etc.) to avoid any delay.
The indicated delivery times are indicative and only correspond to the average processing and delivery times. GoudronBlanc cannot be held responsible for the consequences of a delay in delivery that is not its fault.
In case of damage during transport, the Customer undertakes to make a motivated protest to the carrier within three days of delivery. Delivery times are given as an indication only.
**Article 23-2: Handling of Undelivered Packages by the Carrier**
Packages that have not been delivered to the final recipient for the following reasons: NPAI, not claimed, refused, transport damage, theft…
– Returns due to “NPAI”: These are packages returned with the reason “Does not live at the indicated address”. Once the returned packages have been received by the delivery service, GoudronBlanc will contact the Customer to resend their order (new shipping costs to be borne by the Customer) if the product is still available or to proceed with the refund of the order (excluding shipping costs) according to the Customer’s wishes. If several NPAIs have been identified, GoudronBlanc reserves the right to refund the order and not resend it.
– Returns due to “NOT CLAIMED”: These are packages that have not been claimed by the customer at the post office or relay point within the allotted time. Once the returned packages have been received by the delivery service, GoudronBlanc will contact the Customer to resend their order (new shipping costs to be borne by the Customer) if the product is still available or to proceed with the refund of the order (excluding shipping costs) according to the Customer’s wishes. If several NOT CLAIMED have been identified, GoudronBlanc reserves the right to refund the order and not resend it.
– Returns due to “REFUSED”: If the Customer refuses the package at the time of delivery. After receiving and accepting your package by GoudronBlanc, a credit note will be credited to the Customer’s account within 72 hours of receiving the package. The Customer can request the cancellation of the credit note and its refund.
In case of a return of a package by the carrier due to “NPAI”, “NOT CLAIMED”, or “REFUSED”, GoudronBlanc does not guarantee the reservation of the ordered items and will refund the order if the products are no longer available.
**Article 23-3: Shipping Location**
Products sold by GoudronBlanc are stored in France. They are shipped from the storage location near Grenoble, in Isère.
**Article 23-4: Transport Services**
GoudronBlanc uses the Colissimo and Point Relais services of La Poste, as well as those of Mondial Relay. Once the order is placed, the products are carefully hand-packed and entrusted to the carrier.
**Section 3: Withdrawal, Return, and Refund**
**Article 31-1: Right of Withdrawal**
The Customer, a non-professional natural person, as a consumer, benefits from a withdrawal period of fourteen days from the receipt of their order to return the product to the seller for exchange or refund without penalty, except for delivery and return costs.
The right of withdrawal will be exercised by returning new and properly folded products, at the Customer’s expense, to the address provided by GoudronBlanc.
Any return must include the order number to identify the return package. Returned products must be in new condition and well folded in their original packaging.
It should be noted that the return may be refused if the products have been soiled, washed, worn, damaged due to fitting or use, or if they have taken on a particular odor.
**Article 31-2: Return Procedure**
The Customer must return the products in their original packaging, in new condition (allowing for resale, without having been worn or washed), to request an exchange or refund without penalty.
In case of loss or damage of the package during return, the associated costs will be borne by the Customer.
**Article 32-1: Refund Procedures**
Refunds of products, in the cases of articles 21-3, 23-2, and 31-1, will be made by GoudronBlanc within a maximum period of 30 days after receipt of the said products. The refund will be made using the same payment method chosen by the Customer at the time of the order or by issuing a credit note.
**Article 33-1: Exchange Procedures**
The exchange of products is made by issuing a credit note that will allow the Customer to make the exchange at their convenience on the Site.
**Section 4: Others**
**Article 41-1: Liability**
GoudronBlanc has only a best-efforts obligation towards the Customer for all stages of access to the Site, consultation, form completion, order placement, delivery of articles, or any other service. GoudronBlanc cannot be held responsible for any inconvenience or damage inherent to the use of the Internet network and beyond the diligence and precautions taken by GoudronBlanc, especially data loss, intrusion, viruses, service interruptions, or other unintentional problems.
**Article 42-1: Intellectual Property**
All elements of the GoudronBlanc Site and the GoudronBlanc brand are and remain the intellectual and exclusive property of the company Béton Jaune SAS.
The reproduction, exploitation, redistribution, or use, even partially, of the elements of the Site, whether software, visual, or audio, requires the authorization of Béton Jaune SAS.
Any hypertext link referring to the GoudronBlanc Site and using techniques such as framing, deep-linking, in-line linking, or any other deep linking technique is strictly prohibited without authorization. In any case, any link, even tacitly authorized, must be removed upon simple request from GoudronBlanc.
**Article 43-1: Personal Data**
Information collected by GoudronBlanc during a Customer’s order is necessary for transaction management and may be communicated in whole or in part to service providers involved in the execution of the order. The Customer is informed that these same personal data may also be collected by an organization responsible for order analysis and combating credit card fraud.
Customer data collected by GoudronBlanc may include the following: name, first name, title, email address, date of birth, postal and delivery address, phone number. GoudronBlanc also reserves the right to collect browsing data using cookies, in accordance with applicable legislation. These data are used to offer a better user experience.
These customer data are collected as part of GoudronBlanc’s activities in clothing sales and managing the customer and prospect database through segmentation, prospecting, loyalty, and email communication actions. GoudronBlanc reserves the right to collect information about buyers, including using cookies, and, if desired, to transmit collected information to commercial partners.
We know you love GoudronBlanc T-shirts and polos. Our main communication method with our Customers is email. This serves to keep you informed about new products.
We also collect email addresses from readers of our blog who comment on our articles or download documents. This allows us to stay in touch and announce GoudronBlanc news. It is possible at any time to unsubscribe and stop receiving our news.
Customer data may be collected when:
– you create an account on the Site;
– you visit the Site as it uses its own and third-party cookies;
– you buy our products online;
– you subscribe to our newsletter.
The data recipients are GoudronBlanc’s customer service, marketing, and e-commerce departments, as well as the payment providers listed in article 22-5 and our delivery providers listed in article 23-3. Data transfers with our providers are contractually regulated and comply with the applicable law, ensuring an adequate level of data security.
GoudronBlanc undertakes to delete or archive customer data at the end of a period of 6 years following the last purchase, and prospect data at the end of a period of 3 years following the last interaction.
Customers can object to the disclosure of their details by notifying GoudronBlanc through our contact form. Likewise, users have the right to access, rectify, and delete their data in accordance with the Data Protection Act of January 6, 1978, and the General Data Protection Regulation (EU Regulation 2016/679 of April 27, 2016).
By placing an order, the Customer consents to being contacted by GoudronBlanc. In accordance with the GDPR, it is possible at any time to request GoudronBlanc to delete the collected information and stop sending messages.
Customer data are necessary to confirm the purchase and allow the delivery of the order to our Customers. The collection of customer data is based on the legitimate interest of the data controller.
**Article 44-1: Archiving**
GoudronBlanc will archive the order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code. GoudronBlanc’s computerized records will be considered by the parties as proof of communications, orders, transactions, and payments between the parties.
